Renovations are and important part of maintaining your asset, however we need to ensure that everything is going to be done correctly. The applicaton process protects all owners within a building.

Standard Conditions of Consent:

Works Contract Any residential building work exceeding the value of $1,000 requires a written contract. The contract must be compliant with the Home Building Act 1989. The Owners Corporation must receive a copy of the contract.

Works Home Warranty Insurance Home warranty insurance cover is a requirement for residential building work where the value of the work exceeds $20,000. A licensed tradesperson is required to perform the work. The Owners Corporation must receive a copy of the certificate of currency.

Hours of Work The works must be performed within the Local Council’s prescribed hours of work, or in accordance with any by-laws registered for the Strata Plan or specific instructions given by the Strata Committee.

Occupant Notification A notice period of Seven (7) days is to be provided to all occupants of the Strata Plan. An advertisement must be posted to the notice board and delivered to the letterbox, or under the door, of the immediate neighbours. The notice must outline:

i. a description of the works;

ii. the renovator’s name and contact details;

iii. the telephone number of the primary contractor and their business name; and

iv. the local council’s approved hours of work.

Compliance All work must be performed in accordance with the Building Code of Australia and any other relevant codes, standards or specifications. The work must also be compliant with any development or building consent approved by council.

Licensed Tradespersons Any tradespersons contracted to complete residential building work for the lot owner, where the value of the work exceeds $200.00 or is specialised in nature, must be licensed.

Access to Common Property Where access to common property is required, the lot owner is responsible for any damage that may be caused. If damage is to occur, including dirt or stains left on common property flooring or walls, the lot owner must take restore the affected common property.

Parking Tradespersons and contractors are not permitted to park on common property at any time, unless special arrangements have been negotiated and coordinated with the Strata Committee.

Use of Lifts (Where Applicable) Steps must be taken to protect the lift against any damage, steps may include but are not limited to:

i. Drop-sheets being hung to protect the walls of the lift; and

ii. Protective mats being laid on the floor of the lift. The lift must be released for the use of other residents between the transport of each load.

Waste Disposal The lot owner is responsible for the removal of all trade waste generated by the works. The Strata Plan’s bins ARE NOT to be used for trade waste. The lot owner may organise, in cooperation with the Strata Committee, for a skip bin to be stored on common property. In this case a notice must be provided to residents 7 days before the arrival of the bins and include the location of the bin and the length of time it will be present.

Variations to Approved Designs or Plans The lot owner must advise the Strata Committee in writing with any proposed variations to the approved work. The Owners Corporation must then approve the revised schedule of work prior to the commencement.

Tidiness The lot owner is responsible for making sure that all common areas accessed in relation to their renovations/works including car parks, foyers, lifts, staircases etc remain clean and tidy. If an acceptable standard of cleanliness is not maintained the Owners Corporation will organise for the areas to be cleaned at the expense of the lot owner.

Repairs and Maintenance All ongoing repairs and maintenance requirements relating to the work are to be met by the lot owner.

Indemnity:

By signing below, the lot owner applying for renovations/works indemnifies the Owners Corporation against:

Any damaged caused to the common property, the lot involved in the works or any other lot in the Strata Plan, resulting from the work proposed in this application;

Any cost of repair to the common property and a commitment that any damage will be rectified by the applicant at their expense within seven (7) days;

Any fees and charges incurred in enforcing relevant by-laws or conditions of consent that form part of the approval; and

The cost of any dilapidation reports or defects surveys commissioned (if required) for the common property and/or neighbouring lots of the proposed works.
